The Texas Board of Professional Geoscientists (TBPG) proposes amendments to 22 TAC §§851.104, 851.152, and 851.156, concerning the licensure and regulation of Professional Geoscientists to clarify the section on Dishonest Practice; to clarify the application requirements for Geoscience Firms; and to specify and clarify the requirements regarding use of the Professional Geoscientist seal. The TBPG adopts an amendment to 22 TAC §851.29, concerning the licensure of Professional Geoscientists by endorsement, reciprocal agreement, and reciprocal licensure by similar examination. The amendment is adopted without changes to the proposed text as published in the March 16, 2012, issue of the Texas Register. The adopted amendment to §851.29 mitigates the barriers to reciprocal licensure of persons licensed in other states and jurisdictions who were licensed under a grandfather provision, provided that they meet certain qualifications for licensure. The public benefit anticipated as a result of enforcing the section will be enhancement of the professional practice of geoscientists by allowing professional license holders from other states that don’t have reciprocity with Texas who have practiced competently for a number of years and have adhered to the professional requirement of licensure in their respective state(s) or jurisdiction(s) to qualify for licensure in Texas.
